Chunke Varish ke liye vasiyyat saheeh nahi aur marazul maut me kisi ko bari karna vasiyyat ke Hukm me hai, isliye varis ko bari karna bhi saheeh na hoga aur ajnabi ke liye vasiyyat saheeh hai isliye usko bari karna bhi saheeh hoga lekin ajnabi ko bhi sirf ek tihayi (1/3)-33% maal ke bakaqr hee bari kar sakta hai kyunke Tihayi se ziyadah ki vasiyyat baatil hai (muatabar nahi) to bari karne (qarza muaaf karne) ka bhi saheeh nahi.

Wali (Maiyyat ka qareebee rishtedar) ne khud Namaze Janaza padhi ya uski ijazat se Namaze Janaza padhi gayi (Ijazat chahe saaf dee ho ya dalaalatan- jaise ajaanib (doosre logo ne) Apne taur par namaz shuroo’a ki aur Wali ne uski iqtida kar li) to Farze Kifaya adaa ho gaya aur tamam logo ki taraf se yah fareeza Saaqit ho Gaya (utar gaya)
Ab agar doosre log Namaze Janaza padhna chahe to Hanafi Maslak ke mutabiq unke liye ijazat nahi, isliye ke Namaze Janaza Farze Kifaya hai, jab 1 martaba adaa kar li gayi to sab ki taraf se fareeza Saaqit ho gaya.
Albatta agar Wali ne namaz na padhi ho, aur na uski ijazat se namaz padhi gayi ho, to Wali I’aadah-lotana kar Sakta hai.
Malikul Ulama, Allama Kaasani (Rahmatullah) ne bada’eeus Sana’ia me Rivayat naqal farmai hai : Huzoore Aqdas (Sallallahu Alayhi Wasallam) ne ek janaza ki namaz padhai uske ba’ad Hazrat Umar (Radiyallahu anhu) aur aap ke saath me kuchh log haazir huve aur dobarah Namaz padhni chahi, Huzoor (Sallallahu Alayhi wasallam) ne Irshad Farmaya : “Namaze Janaza dobaarah nahi padhi jaati, albatta tauba aur istigfaar karo. (Bada’ee Sana’ai : 113)

Agar Islami Hukoomat ho to Namaz e Janaza ki Imamat ka avvaleen Haqdar Haakim e Waqt (badshah) hai, Fir uska Nayib, woh na hoto Qazi e Shahar Phir uska nayib aur Agar yeh log Mavjood na ho ya Hukoomate Islami na ho to Zindagi me jis Muhalle ki Masjid me Mayyit Namaz padhta raha ho aur us Masjid ke Imam ki Imamat se Khush raha ho to woh Imam vali (qareeb e maiyyat) ke Muqabila me avla aur behtar hai, Basharte ke woh ilm va Taqwa me vali maiyyat per favqiyat (ziyadati) rakhta ho aur agar Maiyyat is Imam se khush na raha ho ya us imam ke Muqabile me wali e Maiyyat ilm va taqwa me Afzal ho to fir wali hi ko avlaviyyat hasil hogi.
Tambeeh : Is tafsil se yeh bhi maloom ho gaya ke agar Maiyyat ki Namaz e janazah apne Muhalle ke Alavah kisi dusre Muhalle me ada ki ja rahi hai to is Muhalle ki Masjid ke Imam ko wali par Mutallaqan (har haal me) favqiyat aur afzaliyyat hasil na Hogi, Lihaza wahaan ke Imam ko wali ki Ijazat ke Bageir Namaze Janazah Nahi Padhani Chahiye, Balke vali ko Haq hai chahe vo Khud Padhaye ya Kisi Dusre se Padhvaye.

Mere bahut se dost va ahbab non muslims hain mere yahaan agar kisi ka Inteqal ho jaae ya koi museebat paish aa jaae to woh hamare yahaan ta’ziyat ke liye aate hain,
To kya agar non muslims me se kisi ka Inteqal ho jaae to usko taziyat-pursha dene ka kya hukm hai?
Agar pursha dena jaiz hoto uska kya Tareeqa hai?

Non Muslims ki khushi aur gami me Insani, samaji rishte ki wajah se shariq hona durust he balke behtar hai, taake un par Islam ki Faraakh (kushada) dili aur muslmano ki khush akhlaqi ka naqsh (sikka) qaayim ho sake, Isliye non muslims ki ta’aziyat bhi ki jaa sakti hai, fark yah hai ke musalmano ki ta’aziyat karte huve wafat pane wale ke liye dua e magfirat karni chahiye, non muslims marne wale ke ghar walon ke liye muhabbat aur ta’alluq ka izhar kiya jaae. Ghar walon ko sabr aur dheeraj naseeb ho aisee dua kare ehle ilmne non muslims ki ta’aziyat ke liye yah kalimat likhkhe hain

Maiyyat ke ghar Aurate bhi kai Martaba Jama Hoti he, Halanki Aek Martaba Ta’ajiyat kar lene ke Ba’ad Dobarah Ta’ajiyat ke liye Jana Makrooh he.
Bazahir unka Aana Sabr Tasalli ke liye Hota he,
Lekin Hota ye he ke Ahle Maiyyat Ko Sabr Dilane, Dil Thamne Aur Tasalli Dene ke Liye Ek Baat Nahi, Ulta Unko Gam (marhoom ki baaten) yaad dila-dila kar Rona Pitna Shuru kar deti he, Ya vahan Beth kar Duniya Jahan Ki Baaten Karti hai Aur Ahle Maiyyat par un ke bethne ke intizam ka bojh dalti hai
aur kapde itna Bhadakdar pahen kar aati he jese kisi ki shadi me Shareek ho rahi ho, Alawa Unke aur bhi Munkarat-gunah va Mafasid hote he jin se bachna lazim hai.

maiyyit ke gharwalon ki taraf se dafan ke baad khane ki dawat hoti hai us ka khana kaisa hai?
jawab
Agar ye dawat maiyyat ke gharwalon ki hee hai,maiyyat ke rishtedar ya padosi ki dafan me shareek bagarwalon ya gamzada logon logon ke liye nahi hai to is me shadi ki tarah is mavqa par rishtedaron ,doston wagairah jama hona hota hai yah khana kai wajha se na jaiz aur bidaat hai.
1.yah haqeeqat me hinduon ki rasm hai bas us me hinduon ki mushabahat hai.( jo haram hai)
2.shareeat me gami ke mavqa par dawat sabit nahi.
3.is dawat ko zaroori samjha jata hai aur gair zarooree chiz ko zarooree samjhna na jaiz haj.
4.da’wat me jo paise kharch hote hain us me aamtaur par na baleeg, yateemon ka bhi hissa hota hai aur na baleeg ka maal sadqah aur khairat me dena kisi soorat me jaiz nahi.( un ki ijazat bhi moatabar nahi)
5.is dawat ka maqsad isale sawab nahi hota balke dikhlawa karna hota hai ya logon ke ta’ne ke dar se dawat ki jati hai jo ke shirke asgar -chhota shirk hai.lihaza is se bachna lazeem aur zarooree hai.
