jahez maangna jaiz nahi us ki daleel ye hai ke bila haq maanga jaa raha hai, shareeat me jo bhi kharch hai mard par hai, aurat ya aurat ke gharwalon par koi kharch hau hi nahi.

hadees shareef me us ki daleel, Abu humaid RadeeAllahu anhu se riwayat hai ke : apne bhai ka maal bagair haq ke halal nahi, aur woh isliye ke Allah ta’ala ne musalman ka maal musalman par haraam kiya hai.

Arabi madaris aur makatib ke asatizah (ustad) ko tableegi Jama’at me jaane ke liye maahanah (monthly) tin din ya saalanah (yearly) ek chillah ya Zindagi ke char mahine ya ek saal ki chhutty,

isee Tarah batil firqon ki tardeed ke tarbiyati camp, ijtimaa me jane ki chhutti tankhah ke saath dee jaa sakti hai ya nahin?

Agar zarurat ho to dee jaa sakti hai.

Ta’alim ka maqsood deen ki ishaat aur hifazat hai, aakhir madarsah wale madarsah ke paise se risalah bhi nikalte hain, madarsah ke paise se wa’az (bayaan) ke liye bhi bhejte hain, jalson me shirkat ke liye bhi bhejte hain, yeh sab ke sab ta’alim ke maqasid hain,

agar wahaan ke log is safar aur batil firqon ke rad ki tarbiyati jalson ki shirkat ko munasib samjhte hain aur uski zarurat bhi hai to wahaan (jama’at, tarbiyati camp me tankhaa ke saath chhutty) kar sakte hain.

Hazrat saiyyad mufti Abdur Rahim lajpuri RAHMATULLAH ALAYHI likhte hain ke, “madaris wale mudarris (ustaz) barhaye. madrasah ki imarat me kaafi se zaaid paise kharch kar dete hain.

haalaa ke madarsah ki imarat maqsood biz zaat nahin, maqsood e asli ta’alim hai, fir asatizah ke izafe aur unki tankhwahon (salary) ke izafe me kotahi kyun ki jaaye ?”

Khulasah yeh hai ke ta’alimi kaam ke saath tableeg me mashguli bhi honi chahiye, denee anjum (commiitee) tabligi kaam ki zimmedari se subuk dosh (bari) nahin ho sakte,

lihaza ta’alim ke saath tableeg me bhi dilchaspi len aur mudarriseen ko jaari wazife (tankhwah) ke saath tableegi kaam ke liye ijazat den.

1. Agar kisi shakhs ne ek admi ko koi cheez kharidne ko kahaa aur paise apne paas se diye to is vakeel ko Jaiz hai ke yah pausa kisi zaroorat se apne kaam me laye? fir muakkil (mangwane wale) ko apne paise se cheez khareed kar dede ?

2. Kharidne ke baad vakeel woh Cheez laa raha tha ke raste me vakeel se ek dost ne kahaa ke yah cheez mujh ko de do aur tum dusri, baazar se kharidkar muakkil (mangawane wale) ko de do to vakeel (lene wal ko aisa karna jaiz hai?

Vakeel (laane wala) shareeat me amanatdar hota hai amanat ko is tarah ka tasarruf (apni marzi ke mutabiq kisi kaam me istiamal karna) na-jaiz hai. (woh note bhi badalne nahi chahiye) agar woh paie apne kaam me apni marzi se isteamal kar liye to zaamin hoga (agar woh paise ya layi hui cheez bagair galaty kare, kho jaye (barbaad ho jaae) to vakeel (laane wale) ka apna nuqsan samjha jayega ab mangwane wale ka nahi) woh ameen (amanatdaar) nahi raha
(Agar apni marzi me Isteamal na karta woh note ya cheez mahfooz rakhta aur woh cheez bagair bhul ke barbaad ho jati to uska paisa vakeel (laane wale) ko dena nahi padta woh nuqsan muakkil mangwaane wale ka hee hota)

2. Muakkil (mangwane wale) ke paise se jo cheez kharidi hai usko kisi dost ke haath me bechna durust nahi yah maalik ki bagair ijazat ke soda hoga jo mangwane wale asal maalik ki ijazat par mavqoof rahega woh haan kahe to kisi ko woh cheez bechna sahih aur na kahe to kisi dost ko bechna sahih nahi wohi cheez kisi ke paas se wapas lakar asal mangwaane wale dena zarooree hai.

Dukan ke malik ne cheezon ka daam mulazim ko bataye hain, mulazim usko ziyadah qeemat me bechta hai masalan kisi cheez ka 60 rupiye daam hai to mulazim us cheez ko 70 rupiye me bech kar das rupiye apne paas rakhta hai aur 60 rupiye malik ko deta hai to kya is tarah mulazim ko 10 rupiye lena jaiz hai?

Us mulazim ki haisiyat bechne ke wakeel ki hai isliye puchhi hui surat me agar usne us cheez ko jis ke mutalliq malik ne use 60 rupiye me bechne ko kaha tha usne 70 me becha to bechna durust aur saheeh hai lekin zaid raqam 10 rupiye bhi malik ki milk samjhe jayenge woh mulazim woh raqam apni jaib me nahi rakh sakta, agar aisa kiya yo yah khayanat hai.

Agar ma’alum hai ke kis ke paas se aaya hai tab to usee ko de de jis tarah bhi mumkin ho chahe bataa kar chahe dhoka dekar (chupke se isliye ke yah haqeeqat me aapne haq ko hasil karna hai jo jaiz hai)

Agar ma’alum na ho to kisi aur ko dhoka dena jaiz nahi, bataa kar diya jaye, chahe lene wala kam qeemat par le, ya agar kisi jagah usse zulman liya jaye to wahaan bila bataye bhi dena durust hai.

Agar gaalib gumaan hai ke uska maalik khud talaash karega to woh cheez usee ko mil jayegi yah cheez zaye’a nahin hogi to nahin uthana chahiye na uthane se gunehgar na hoga lekin is surat me bhi agar utha liya to asal maalik tak pahonchana waajib hai khud rakh lena durust nahi.
