MUKHTALIF HAALATON ME NIKAH KE MUKHTALIF HUKM
NIKAH KARNA KAB FARZ,WAJIB, SUNNAT,HARAAM AUR MAKROOH HOTA HAI?

Jawab

Farz :-

Kisi shakhs per shahwat ka is qadar galba ho k agar nikaah na kare to zarur zinaakari me mubtala ho ja’ega,

Aur usko baqadre zarurat nafqa-kharcha aur mahar per haqeeqatan ya hukman qudrat bhi haasil he,

Shar’an us per farz he k shaadi karke apni ismat-pakdamani ki hifazat kare

Wajib: –

Agar kisi per shahwat ka galba he k shaadi na kare to zina me mubtila hone ka khauf he, lekin yaqeen nahi,

Aur usko bivi ke naan v nafqa per qudrat bhi haasil he,

Aise shakhs per shaadi karke apni ismat-pakdamani ki hifazat wajib he

Sunnat :–

Agar koi shakhs nikaah ke qabil ho gaya, naan nafqa-kharche per qudrat haasil he aur hambistari per bhi qudrat he, nikaah se koi aur shara’i rukawat mojood nahi, aise shakhs ke liye nikaah karke ba izzat zindgi guzaarna shar’an masnoon he,

Kyuki yeh rasulullah sallallahu alayhi wasallam ka daa’imi-hameshgi ka amal he,

Aur shaadi se earaaz karne walo per aap sallallahu alayhi wasallam ne radd farmaya he,

Lihaza aisa shakhs itteba e sunnat ki niyyat se apni ismat ki hifazat aur saaleh aulaad ke husool ki niyyat se shaadi kare to ajro sawab hoga

haraam :–

Agar kisi shakhs me bivi ke huqooq adaa karne ki taaqat na ho,

maslan na mard he, ya naan nafqa per haqeeqatan ya hikman qaadir nahi, neez mijaz ki sakhti vagairah,

Kisi vajah se usko yaqeen he ke bivi ke huqooq adaa nahi ho sakenge,

To aise shakhs ke liye nikah karna haraam hai,

Makrooh tehrimi :–

Jis shakhs ko bivi per zulm ka yaqeen to na ho lekin galib gumaan yahi he ke zulm ho ja’ega,

To aise shakhs ke liye jab tak ada e huqooq per qudrat na ho nikaah karna makrooh e tehrimi hai
