Bap ne makan khareeda tha isliye asal khareednewala to baap hai bete ke naam par kisi maslihat se sirf dastawez bana dene se beta malik nahi hoga jab tak us ko hiba-bakhshish kar ke us ko malik na banaye.

Marzul maut me Varis ka qarza muaaf karna Saheeh nahi, ajnabi ka qarza muaaf karna saheeh hai.

Chunke Varish ke liye vasiyyat saheeh nahi aur marazul maut me kisi ko bari karna vasiyyat ke Hukm me hai, isliye varis ko bari karna bhi saheeh na hoga aur ajnabi ke liye vasiyyat saheeh hai isliye usko bari karna bhi saheeh hoga lekin ajnabi ko bhi sirf ek tihayi (1/3)-33% maal ke bakaqr hee bari kar sakta hai kyunke Tihayi se ziyadah ki vasiyyat baatil hai (muatabar nahi) to bari karne (qarza muaaf karne) ka bhi saheeh nahi.

Iintiqal ke kitne din ke baad marhoom ki meeras (wirsa) taqsim karna chahiye?

Shareeat ka hukm hai ke tarakah (maiyyat ke chhode huve maal) me jin huqooq ki adaygi wajib hai, Masalan kafan dafan ka kharch, qarza, jaiz wasiyyat ho to uski adaygi ke baad baaqi meeraas jald warison ke darmiyan taqsim kar dee jaye.

Taakheer hone se bahut ziyadah pechidgiya (dushwariyan) aur bad-gumaniyan paida ho jaati hai, baaz martaba ziyadah taakheer hone se taqsime meeras me sakht uljhane aur mushkilat paida ho jaati hai. maslon ko hal karne me pareshaniyan ho jaati hain. aur haq-talfi tak ki naubat aa jaati hai.

Ye khyaalat bilkul bekar hai ke marhoom ka tarkah (wirsah) fauran taqsim kiya jaye to duniya yah kahegi ke bas isee ka intizar tha ke marhoom ki aankh bandh ho aur uske maal saman par qabzah kar liya jaye,

magar Allah Ta’ala ke hukm ke aage yah sab khyalat aur jazbaat bekar hai, sab warison ko bata diya jaye ke tarkah ki taqsim Allah Ta’ala ka hukm hai, lihaza uske mutabiq jald se jald Amal kiya jaye.

Me bada bhai hun Walid sahab ka intiqal ho gaya hai us waqt se karobar mene sambhala tha meri dusri do badi bahan aur do chhote bhai hain sab saath me rahte hain aur kharch me chalata hun. unki taraf se wiraasat ki taqsim ka koi taqaza nahi hai,

Ek bahan ki shadi bhi mene karai. sab maal milkat me jo kuchh kaarobar ke liye karna ho ham ne ek dusre ijazat dee hai to kya fir bhi wiraasat ki taqsim shareeat me zarooree hai?

Aap ke bhai bahan aap ke maatahat (under) me hain isliye Sharma sharmi me kuchh nahi kahte magar dil se koi ijazat nahi deta isliye unki zahiree Ijazat mu’atabar nahi jiski bina par ek waaris ka tamaam maal par qabza kar lena bilkul haraam aur na-jaiz hai,

Khaas kar us surat me jab ke baaz waris naa-baalig ya paagal ya gaaib hon, Kyun ke gaaib ki ijazat ka kuchh ilm nahi aur na-baalig aur paagal khush dili se saaf saaf ijazat de to bhi unki ijazat mu’atabar nahi.

Lihaza azabe qabr aur azabe jahannam se daren aur zulm wa maal dabane se baaz aaye aur warison ko jald az jald unka haq pahonchaye.

Wirisat ke zariye jo milkat warison ki taraf muntaqil hoti hai zabardasti (galepadu) ki milkiyat hai, na usme wariso ka qubool karna shart hai, na uska usi par Raazi hona zaroori hai,

Balke agar woh zuban se saaf taur par yun bhi kahe ke me apna hissah nahi leta tab bhi woh shar’an apne hissah ka Malik ho chuka.

Jo log bahno ko hissah nahi dete aur woh yah samajh kar dil na chahte huve bhi Sharma sharmi maaf kar deti hain ke Milne wala to hai hi nahi to kyun bhaiyo se burai leve, aisi muafi se shar’an muaf nahi hota,

Unka haq bhaiyo ke zimme wajib rahta hai, yah meeras dabane wale sakht gunahgaar hain.

Isme ba’az bachchiya na-baalig bhi hoti hain usko hissah na dena double gunah ek gunah warise shar’ee ks hissah dabane ka, aur doosra yateem ke maal ko khane ka.

(Lihaza kisi ko uski bahan ne muaf kar diya ho fir bhi hissah pahonchaye warna aakhirat me iska hisab dena padega

Haqeeqat me muaf us waqt hoga jab woh apne hissah par qabza kar le aur khush dili se bila sharm aur dabaao ke wapas kar de)
